Kumusta po ulit......
     Nagkaroon po kami ng Curfew Ordinance sa Barangay...ang cover po ng ordinance na to ay mga batang edad  18 years old and below.  Kasi po rampant po yung mga incidents ng panggugulo ang involved ay nasa ganung age...Mostly from 13 years old to 18.Ngayon po ay nag pass kami ng  ordinance which prohibit minors from loittering from 9:00 pm to 5:am. Ngayon po ag lalabag sa ordinansang ito ay magkakaroon ng penalty.

        First offense - - - -  advice ng Punong Barangay and Sangguniang Barangay
        Second offense - - -  4 hours community service
        third offense - - - - - 8 hours community service and fine of 100.00 One hundred pesos charged to
                             parents/guardian.....

Nagkaroon naman kami ng Public hearing kasama yung mga constituents at wala namn pong pagtutol....
Ngayon po nung nireview ng Sangguniang Bayan..., Ibinalik sa amin yung ordinance at pinatatanggal po yung penalty clause. Sad Shocked Huh...Ano kaya yung ordinansa na walang penalty????Paano kaya yun Sir.....Kasi po yung naging dahilan nila ay lalabag daw sa RA 9262....paano po kaya ang best remedy doon....pls. help us para sa Kabataan din naman yung iniisip ng council sir.....Thanks sir sa inyon magiging pagsagot...alm ko po na matutulungan nyo kami....

You have no choice but to follow the directives of the Sangguniang Bayan. Sangguniang Barangay has no override power and you cannot implement that ordinance without approval of the Sangguniang Bayan.

Only the legislature can create penal laws.

Derivative legislative power lang ang sa inyo.

SEC. 57. Review of Barangay Ordinances by the sangguniang panlungsod or sangguniang bayan. - (a) Within ten (10) days after its enactment, the sangguniang barangay shall furnish copies of all barangay ordinances to the sangguniang panlungsod or sangguniang bayan concerned for review as to whether the ordinance is consistent with law and city or municipal ordinances.

 (b) If the sangguniang panlungsod or sangguniang bayan, as the case may be, fails to take action on barangay ordinances within thirty (30) days from receipt thereof, the same shall be deemed approved.

 (c) If the sangguniang panlungsod or sangguniang bayan, as the case may be, finds the barangay ordinances inconsistent with law or city or municipal ordinances, the sanggunian concerned shall, within thirty (30) days from receipt thereof, return the same with its comments and recommendations to the sangguniang barangay concerned for adjustment, amendment, or modification; in which case, the effectivity of the barangay ordinance is suspended until such time as the revision called for is effected.

SEC. 58. Enforcement of Disapproved ordinances or Resolutions. - Any attempt to enforce any ordinance or any resolution approving the local development plan and public investment program, after the disapproval thereof, shall be sufficient ground for the suspension or dismissal of the official or employee concerned.

   Sir , tanong ko lang po ulit kung ano po yung magandang gawin doon para naman mabawasan yung juvenile negligence sa aming barangay .....Thank you sir and more power po ulit sa inyong lahat .....

Then why not look for a City Ordinance implemeting curfew and enforce it? Baka kasi dinis-approved ng City dahil may existing Ordinance na to that effect?

      wala pong municipal ordinance ng curfew Tito Boy dito sa amin......Hindi po kami city Sir....kaya nga po gumawa ng effort yung barangay council to implement curfew ordinance...yun nga po yung nangyari inapprove  po yung ordinance  pero ipinatatanggal naman yung penalty clause.....baka po kasi maging katatawanan lang ang barangay  kung me batas pero wala namang  kaukulang parusa......Tsaka Sir, pwede po bang iderekta na sa Sangguniang Panlalawigan  yung aming ordinansa baka sakali kasing doon eh maapprove.....Thank you Sirs.......More power po sa inyong lahat... salamat po sa inyong mga sagot...this help us alot....barangay secretary po kasi ako....

You cannot go directly to Sanguniang Panlalawigan. Ordinances of Sang. Brgy are subject to the approval of Sang. Bayan or Lungsod.

mamm, puwede ba akong makapagshare sa topic nyo. sa amin po mamm, ang gawa po namin pag may nahuhuli kami tungkol sa carfew.
    first offense---- pinatatawag po ang parents or guardian at pinagsasabihan
ang bata sa harap ng magulang at papauwiin na.
    second offense---4 hours community service
    third offense-----8 hours community service and 3 days counciling sa bata at sa magulang.  Thanks po sana nakatulong ito. thanks din po tito Boy. more power po sa site na ito.

Pasensya na po newbie lang kase kaya di ko alam kung paano mag start ng topic.
Nais ko sanang  itanong kung san po kami pwedeng lumapit na ahesya ng gobyerno dahil masyadong po pinanghihimasukan ng aming Kapitan ang mga policies na gusto naming ipatupad sa aming Subd. Tulad po ng pagkakaroon ng Terminal ng Tricycle sa loob ng aming subd at pinili pa po nilang ipuwesto ito sa mismong Club House namin. Nailapit na po namin ito sa tricycle regulatory broad ng aming munisipyo ngunit sadya raw pong malakas ang aming Kapitan sa munisipyo. Ang dahilan din po kaya masyadong pinapaboran ni kapitan ang mga TODA ay dahil sa karamihan dito ay mga kamag anak nya o mas maraming botante syang makukuha kumpara sa aming mga taga subd. Ang nasabi pong terminal ng tricycle ay dinaan namin sa botohon ng mga residente sa aming subd at lumabas po sa nasabing botohan ay karamihan talaga sa amin ay di payag dahil sa iba't ibang reklamo tulad ng, merong mga drivers na walang lisensya, walang prangkisa at rehistro ang mga tricycle.

Nailapit na po namin sa munisipyo, ang problema po ay malakas umano sa mayor ang kapitan namin.


Try mo sa Office of the Mayor. kung pribado kayo subdivision pede kwestyunin ng HOA ang ginawa ni kapitan.
